Small Claims Procedure

The Parliament has approved the legislation on the procedure for small claims. The entry into force of the legislative amendments still requires the confirmation of the President of the Republic. More information on the introduction of the new procedure will be provided later on this web page.

The small claims procedure is a new type of court procedure that is followed in the district court. The procedure can be used to deal with disputed matters arising from a tenancy agreement for a dwelling, where the claim is no more than EUR 10,000 in principal at the time the action is brought, or where the issue is not about money but, for example, eviction. In addition, it is required that the matter is not extensive or difficult.

The new procedure is intended to promote access to justice. The threshold for bringing a case before the courts is lowered because the law has a clear ceiling on how much the loser of the case has to pay for the winner’s legal costs. The new procedure is also a simpler way to deal with the matter than a full-scale trial.
